1.1. These General Terms and Conditions (the "Agreement") govern the relationship between you, the Client, and Nomacaps, a company established at Sint Gerardusplein 109, Eindhoven, Netherlands ("Company", "we", or "us"), in relation to the provision of goods and/or services.
1.2. Prior to the conclusion of any distance contract, the Client will be provided with these terms in a durable medium. If not feasible, we will inform you how to access these Terms and request a free copy.
1.3. By accessing or using our services, you acknowledge that you have read, understood, and agree to be bound by this Agreement.
1.4. This Agreement contains a mandatory arbitration clause (see Section 17) requiring individual dispute resolution via arbitration.
Agreement: These terms governing the supply of Nomacaps's goods and/or services.
Client: Any user of our website or purchaser of goods/services.
Company: Nomacaps, located at Sint Gerardusplein 109, Eindhoven, Netherlands.
Digital Content: Downloadable or accessible non-physical content.
Distance Contract: An agreement concluded remotely via digital means.
Goods: Physical items sold by Nomacaps, including supplements.
Offer: The Company's proposal detailing product/service pricing and terms.
Privacy Policy: Nomacaps's privacy practices, available on our website.
Services: Website functionality, digital content, and subscription offerings.
Website: https://nomacaps.com or its subdomains.
You will be presented with an Offer after completing a short questionnaire or form on our website.
By ticking the box "I agree with the Terms & Conditions" and clicking "Submit", you accept the Offer and conclude a contract.
The contract is effective upon your acceptance of the Offer.
We will confirm acceptance electronically.
While we strive for uninterrupted service, we cannot guarantee performance due to third-party dependencies. Use of our services is at your own risk.
We reserve the right to modify, suspend, or discontinue services at any time without liability.
You must be at least 18 years old to use our services. You are responsible for preventing minors from accessing them.
Prices remain valid during the Offer period, except for VAT changes.
You agree to pay all applicable fees and taxes, provide accurate payment details, and use an approved payment method.
Payments are processed via secure third-party gateways. We do not store credit card data.
Prices are listed in Euros (unless otherwise stated).
Goods remain our property until fully paid.
All transactions are encrypted and subject to the payment provider's terms.
Our services may be offered on an auto-renewing subscription basis.
Unless cancelled, your subscription renews for the same duration as the original term.
You may cancel by logging into your account or contacting us at [email protected] at least 48 hours before renewal.
Subscriptions purchased via app stores must be cancelled via your Apple or Google account.
If you cancel before the second billing, any applied discounts will be reversed and charged.
Trials convert to full subscriptions if not cancelled before the trial ends.
Refunds are available only if the product is defective or you meet the return policy criteria.
Refunds are processed within 10-30 business days post-verification.
We are not responsible for incorrect shipping information.
To return goods, contact us within 14 days. Items must be unopened and in resaleable condition. Return label cost (EUR9) will be deducted.
Faulty items are eligible for a 14-day limited warranty.
Misuse or unauthorised alterations void warranty claims.
